I have lurked and queried on this subject for a few years.
Seems to me that my prediction of a 2 step process will win the day. Settle the East/West most likely the Nic then apply MB to the final LUS list with the LAA. Then whatever the arbs can dream up to ensure that no one is happy for the SLI.

You guys are positive you know what will happen. I have no idea what will happen... It's an arbitration, but I assure you it will be "fair and equitable" and unassailable.. Regardless of who is stupid enough to spend a dime on lawyers to argue otherwise.

Learn to love the protocol agreement and the BOA decision now because you won't ever change them.

I am not the one suggesting the protocol agreement is of doubtful authority since I didn't participate in the drafting. Your attorney is.

I'm very at peace with it. I just firmly believe it will be the Nic with the AA list. I could be 100% wrong, but after reading the transcripts of the first week, I'm more convinced the Nic will be the list used on the LUS side. Read Brown's testimony, specifically the statement from the arb that the EPSIC is essentially trying to reconstruct a previously arbitrated seniority list.

It's an arbitration. I don't read Tea Leaves or Chicken Bones either. It will be what it will be, when it will be, fair and equitable, for all time after the moment it is published.
