FDX Return from long term MLA
#31
I did not accrue vacation nor did I get my sick leave as I was out for 14 months with a return date in the Month of May several years ago.
I would be very interested in anyone that got their sick bank back after a long term MLA.
I did read the section of the contract about vacation accrual and I don't have a beef with that section.

I was gone roughly two years between 2010-2012. I did not use any sick the year before I went on LTMLA and didn't receive any sick accrual upon return(Although I did a few years prior in full). I did not receive any vacation accrual, (Although I did a few years prior, paid by check in full). I did not receive the contract bonus. I was not aware of making up the 401K.
I inquired about all three (Sick, Vacation, and the Contract bonus) with our Union Mil Affairs Rep and the Company. The Company said I was not eligible for any of those anymore, and our ALPA Mil Affairs Rep never replied back to my questions. I assumed a negative reply was a no reply and I was getting no where with the Company. Hearing that many of you have not heard back from our Mil Rep has me thinking that I should have pursued the issues further. When I have heard back from our Mil Rep, it has been great and thorough info, but I do have to say it is hit or miss receiving a reply.
It would be nice to have a one stop shop for returning LTMLA pilots, or at least someone to help guide us. There does seem to be a recurring theme about our ALPA Mil Affairs Rep.
On a side note, a guy from my unit recently returned in 2013, and received all of his sick back, no vacation, and a B Fund contribution he thought was grossly short.

I returned from a roughly 3 1/2 year absence. I received no sick, vacation, and as I mentioned before no contract signing bonus.
I know of two people who had their sick accrued in full upon return. One of which was gone seven years, and had his full amount returned and put into his DSA. He showed me on VIPs.
Raptor, any ammo you can provide on the contract bonus would be great. The Company was pretty adament that I did not qualify for that bonus because I was on LTMLA at the time.

Details like who they contacted to get things right would be greatly appreciated.

Highly recommend you all work through your Mil Committee first.
All dependent on CBA. At UPS, no vacation accrual, no sick bank because of the CBA language. You maintain longevity, so when return, you start accruing at the rate as if never left. But no retro.
We did win the Contract payout. UPS initially said No.
All pension should be easy to calculate based on what you could have held (step through each phase of seats held/could hold).
CBA affects USERRA DOL VETS. Best example for you may be Americans pilots filed a complaint about CBA application of Vacation and Sick not applied correctly to MLA.
Went to DOJ level before AMR corrected the problem.
Again, very specific to each CBA.
Good luck

Salty Dog,
Great inputs!
Unfortunately, at least for me, multiple attempts of getting our Union Mil Rep to help has fallen on deaf ears. I really wish he would help, as past experiences with him were great with great info/guidance. I have received input from the DOL, who asked me to try and resolve the issues with the Company directly. Not surprising, the Company so far hasn't been to willing to resolve, unless it is to their favor. I hope that changes.
I am no lawyer, but there is both CBA language and precedence for these subjects to the benefit of the returning military member. Raptor may have more legal foundation on the topics in the previous posts. I took Raptor's recommendation and forwarding my direct questions to Capt Wright.

Didn't want to start a new thread, but I have a question.....
I've had to drop several large trips for drill weekend. I'm not complaining about that, sometimes it's part of the deal. I know we get b fund contributions for long term mla, but what about a short term leave?
Also, are those considered pensionable earnings?
