I’m aware of any EUA vaccine use with well documented litigation outside of the military to my knowledge, but that has different problems given that it’s the government.
When the whole issue of mandates came up around the time the vaccines became available, everyone and their brother started writing legal opinions on the subject to include the FDA, OSHA, DOJ, etc.

Now different states may pass other legislation that explicitly outlaw EUA mandates, but I’m not aware of anything.
I’m not sure what you mean with the 1905 case as that was I’m found in favor of the the state (not a private company) issuing vaccine mandates. Either way, I don’t see anyone changing the characterization of the vaccines to a therapeutic given that the most common vaccine given for respiratory illnesses is the flu vaccine and it has worse efficacy.

You're right, people have moved on from the china flu hysteria, at least in most of the country.
And when it comes to losing my freedoms, guaranteed by the Constitution, yes I will chose that hill. See you on the green.
