Default 23rd scope arbitrator rules

Don't shoot me here, just something to think about. Soon this expedited grievance decision is being handed down for the 35 RJs. There's a possibility the arbitrator decides the DALPA pilot group is being stupid, and we must negotiate on scope.

I KNOW, most of us believe scope is not for sale, and we should be clawing back all the planes from the outsourced help. Maybe we're all right in the head, but the arbitrator can still force us to negotiate or hand us a bad deal.

One idea, find out what this 35 rj stuff makes in revenue and demand that part of the wide body flying back. I know we are probably trading 35 rjs for 2 more widebody flights, but who knows. Maybe we convince the company using their own arguments against them wide body flying isnt worth what is was and wont be for 5 years and we get back to 43%\57%. Who knows, just saying its a road you might wanna consider if the arbitrator doesnt like our attitude. All i ask, is if that's what he decides, we go easy on the MEC.

It’s unlikely he will force us to negotiate. The arbitrators exert that kind of pressure prior to ruling. If he issues a ruling it’s likely to be the aircraft are allowed or not allowed. At that point it’s over. Delta can of course ask for additional RJ’s in contract 2030 or whenever we get it done.

I had a feeling this was coming and from the beginning believed the scope is not for sale slogan was silly. But when it comes to Scope folks tend to go red really fast and not think rationally.

I think what you've proposed are a very good ideas. Also to consider:

Update the SNB contract language to include all the 220 option forcing the company to execute the options

Negotiate the retirement of all Endeavor CRJ200s with those block hours replaced by mainline.

Permanent positive space commuting

No middle seat DH, automated checkin using the fly Delta App, and priority boarding

5:15/Day for training

Not saying it's likely. In fact, I should have said its unlikely. I just feel like the "scope aint for sale" crowd (and i count myself among them) does need a little flexibility in the back of their noodle that we are being stupid, we should be self aware enough to know that.

It has happened, I just want to prepare people the arbitrator can really gut punch both sides if he feels like it. Arbitrators don't seem to enjoy hardcore negotiating philosophy... all forces bend, just be ready to in the unlikely event.

I read that we are both supplying one last round of clarifications this week? Or was it last week? Anyone hear if the arbitrator has given any indication of a ruling?

From MEC News 12 August 2021:


Post-Briefings Filed
On July 13-15, 2021, the System Board heard MEC Grievance 21-07. ALPA and the Company presented opening arguments and called witnesses. On Friday, August 6, 2021, both parties filed post-hearing briefs and shared them with the Arbitrator. The Arbitrator has also requested additional briefings, which will be filed later this week. This dispute remains on an expedited timeline, with a decision from the Arbitrator expected by August 23, 2021.


The MEC sent this out on 12 August.

"later this week" according to my reps meant by the end of the week beginning 16 August.

Additional briefs are filed expect ruling next week.




You should talk to your reps more.


Scope. No. No gives. Zero. Delta Pilots flying Delta passengers always should be our goal. Period.

I'm in the scope is not* for sale crowd (*unless they have a wildly amazing list of gives). The list you made is small potatoes compared to 35 large RJs. I'm talking 1st class DH everywhere, abolish the optimizer, Panda Express crew meals... You know, big potato stuff.
