You forgot line 6 just above it, which now applies because trips are being withheld - it's only in base pilots for withheld OE. Here's the pertinent verbiage from the Negotiator Notepad 15-06.
This process can only be used if the trainee is conducting his OE in the same base as awarded. In other words, if a NYC 717B pilot has an OE conducted on an ATL 717B rotation, then that time must remain available to be awarded to any ATL 717B pilot as it is today. Rotations can only be subject to the removal process if the pilot conducts his OE on a rotation in his awarded base. Just as today management will be able to do out of base OE. Just as today, they'll have to drop a trip for an FO. Only in base OE is affected by the trip withholding. It would be nice if you could edit your post above so folks can have correct information. Line 6 is unchanged from C2012 and it says "6. Initial line awards will be made in seniority order among pilots in category." So up to this point is the line award process is the company publishes a bid package, the pilots bid on it, the bid closes, the lines are awarded in seniority order. Unchanged from C2012. Line "X. The company will designate..." starts the OE pull provisions. It doesn't say anything that says rotation can only be subject to the removal process if the pilot conducts his OE on a rotation in his awarded base. It needs to specifically say "in category." Because to me in category is not a given in this section of the contract. If you look in line 1 it says "for his category" and line 6 says it again "pilots in the category", so therefore, if something is limited to "in category" it needs to be specifically said "in category". If in category was meant for the whole section then in line 1 and 6 they would not have to get specific about it. And line X does not mention in category so I do not believe it applies. So the way I see it is my ATL category will be the one where the most trips are pulled as they conduct training for DTW, NYC and LAX. Is there anything else other than Line 6 that says this will be kept in category? http://i938.photobucket.com/albums/a...pscc6d10c4.png |
