In other words, we the Delta pilots, entered into a legally binding agreement with Delta. And Delta says that they don't have the ability to comply with that agreement.

Is that not illegal? In writing they agreed to perform X amount of flying and then later claim a JV partner will not pull down flying. If that's the case then we need a contract with Air France instead of Delta since they can't comply.

That's the funny thing, they also got into a legally binding agreement with Air France, but apparently it's ok for them to ignore the agreement. I guess Delta is just passing it along.
