It is believed to be a steering issue, or at least that's the rumor.
Unless there was willful non-compliance, they will be covered by ASAP under any and all circumstances. |

Also the FAA usually busts people for sterile cockpit in situations like this...sterile violations are consider willfull so no asap help there. Of course it's theoretically possible they were in 100% compliance with sterile... |

Example: A pilot busts an altitude. He files asap and also ATC files a deviation. The FAA pursues enforcement action. ASAP report keeps you from getting ticket yanked and you get remedial training instead (or Administrative letter, etc.) Acceptance criteria for ASAP: 1. Inadvertent 2. No criminal activity, drugs or alcohol 3. Submitted in a timely manner...generally 24hrs |

As mentioned above, if the ASAP is submitted in a timely fashion (24 hours from the closing of the day), and there was not any willful noncompliance, the crew will be protected. It is the agreement we maintain with the FAA regarding certificate action and retraining; and it's the agreement we maintain with the company via our MOU for punitive action (please see unionized carriers with ASAP programs). |

Sully dead-sticked an Airbus with a dual engine failure into the Hudson without loss of life. Expressjet skidded off a runway. I don't think the FAA would extend the same courtesy to this crew. Glad everyone made it out ok.
