Default Subpart k

What is exactly subpart K? I am interested in a private charter company where the members of the club owns the aircraft that way there will not be so strict on maintance. Service will be provide via a seaplane from a remote island with 300 plus population but not enough to support to a part 135

I know I can start a llc and sells shares out to some members but I am not quite sure that will be legal...

Subpart K of FAR 91 is for fractional operations which is what your proposal sounds like--the rules are pretty close to FAR 135 in terms of standards, maintenance, etc.

Subpart K only applies if more than 1 airplane is used and an aircraft interchange agreement is in place. With just 1 airplane, you can indeed sell shares in the airplane. However, you will need to consult an attorney with knowledge of this type of arrangement to insure that you are structured in such a way as to not be in violation of 135.
