Default plane rides

Hello, would it be illegal for me to offer plane rides for the cost of renting the plane to the general public if I hold a commercial ticket?

See FAR 135.1 (a) (5).

There you will find the requirements to do airplane rides. Non-stop within a 25NM radius of the airport, you must be drug tested.

Somebody also said on APC recently you are required to have 500 hours TT, or will have to soon. Don't know about that deal.
So wouldn't you also be subject to the regs under 135? That includes maintenance, etc... I don't think you can do it unless you own your own plane.

Plus I believe the FAA has ruled that you are being "compensated" by getting flight time outta the deal....

§ 135.1 Applicability.

(5) Nonstop sightseeing flights for compensation or hire that begin and end at the same airport, and are conducted within a 25 statute mile radius of that airport; however, except for operations subject to SFAR 50–2, these operations, when conducted for compensation or hire, must comply only with §§135.249, 135.251, 135.253, 135.255, and 135.353.

§ 135.249 Use of prohibited drugs.

§ 135.251 Testing for prohibited drugs

§ 135.253 Misuse of alcohol.

§ 135.255 Testing for alcohol

§ 135.353 Prohibited drugs.

so I would have to meet 135 minimums. I was just gonna rent a plane and take up my fellow college students for cost. How would I drug test myself anyway?

Look again, 135.1 (a) 5 tells you ONLY the regs you must comply with. They are all about drugs and alcohol. None of the regs cited is 135.243, so you do not have to meet 135 mins.*

Back in the day, I worked for an FBO that did rides. I only had to do drug testing. They were a 135 operation.

*I have heard of some changes coming to flying scenic rides, change may be on the horizon. I know no details of said changes.

You can't feasably put yourself on a drug program. Why don't you see about working for someone else who does rides.

You are allowed to "share" the costs of a flight without any additional qualifications - in fact, you could do that with a PPL. No where is it stipulated how much your share would have to be.

If you do it this way, I wouldn't advertise it anywhere - that could be construed as holding out to the public a commercial service. I also wouldn't do this in conjunction with any events like fly-ins or anything that would form lines waiting for rides. You'd just be drawing attention to yourself and would probably get you a call from your friendly local FAA person.

Just pass the word that you'll take friends up if they chip in. You determine what they need to chip in.

A private pilot may not pay less than the pro rata share of the operating expenses of a flight with passengers, provided the expenses involve only fuel, oil, airport expenditures, or rental fees.

How about the drive to the airport fee...you can play with the numbers but good luck.
