If you watch the video closely it looks like even if he didn't havew his phone in his hand, the bag in front of him blocked the view of the missing safety guard until it was too late.

He had his head down buried in his phone and the first thing he did when he got on his feet was to pick up said phone. You know, priorities.

That argument will not hold up in court.
There is a reasonable expectation of safety.
The FAA isn’t involved and its not a Boeing.
