I'm not sure you have an expectation of privacy in the cockpit considering the CVR and wearing the headset for intercom and radios, plus the requirement of the FCC license. There's no hidden microphone, it's right in front of your lips. Having said that, other than major embarrassment for the pilot and a possible "teachable moment" or "oppportunity to excel" for the airline nothing should be done about it, it's probably happened to just about everybody. Although, isn't it PRIDE month? Awkward ....
