Thats not a penalty for not following the contract. Thats compensation for an ERROR in the awarding of a rotation, line or reserve. There is plenty of compensation for errors, extended into days off, etc. There is no blanket penalties for the company not following a section with out having to grieve it and at the very least getting a cease and desist.

Dunno then. I know I see payouts in the hundreds of hours regularly for contractual non-compliance. Something like “if you flew a trip you weren’t supposed to fly you get paid the original trip value plus 1x more of the trip you flew (so roughly 3x) and company must pay the pilot who should have flown the trip you flew. Not expressly written in the CBA but can find in the CBA how those pays were derived. Hundreds of hours typically reserved for when it happens to multiple crew on same trip.

Other airlines have a penalty such as additional pay or an extra day off. We have nothing except a drawn out process where the company (months or years later) eventually says “ok, we won’t do it again” and nothing happens. This is a critical item for the union to address in negotiations; otherwise, our contract has no teeth and there is no incentive to follow it, making all the negotiated items a moot point.

It is important to be aware of this. I encourage all pilots to submit a PDR to the union asking for this issue to be addressed.

There is something not correct in this post. ALPA attornies are salaried and don't work on percentages. I have never noted them to get a cut of any award. Nor have I ever seen ALPA take a cut. They get there cut via dues. Can you provide any supporting documentation for what you state?

I beleive some or at least one ALPA lawyer did recieve a monetary award for work done on the UAL ESOP.

Were they hired outside of the scope of their ALPA job?

Im curious about this as well.
