Unfortunely precedent is on management's side. THis case has already played out in this industry as well as others and the courts sided with management.

Yup, at UAL with IAM members in the bankruptcy. I haven't heard anything about the DAL guys that were terminated, but none of them are back on the property after nearly 2 years.

Is it just me or is this horseshlt? So if I get married and eventually divorce my ex could possibly get my retirement benefits.

Note to self, never get married.

In most states if you get married 1/2 of anything acquired during the marriage is hers (or his as appropriate) ...... This would include 401k, defined benefits, houses, etc. The there is that other problem of alimony.

Houses, cars, bank accounts etc... yes. But qualfied retirement plans are treated differently.

As per the Qualified Domestic Relations Order, a calculation is made to determine what the actuarial equivalent of a participant’s projected monthly retirement benefit would if the joint and 50% survivor annuity option were elected at the time of separation.

The lump sum equivalent the aggrieved spouse is entitled to is less than 50% of the present value of the participant’s total accrued benefit in the case of a defined benefit pension plan, and less than 50% of the account balance contained in an account under a defined contribution plan.

That’s where a good ERISA attorney, and Actuary come into play.
