And the display is right there. The screener can see you and you can see yourself. I should have ordered the 8x10 glossies.

Our freedoms are our birthright. They were given to us by god if you believe he exists. (I don't) These rights are not yours to surrender. The TSA is clearly in violation of the 4th amendment. I seriously doubt groping granny and 6 year olds is keeping us safe. Al-qaida must be laughing their asses off as we shred our own bill of rights.

The fact is, when you accept the process, you waive your 4th amendment rights.

The issue is, TSA screeners (I will not use the term officer) are not trained in the 4th amendment as LEO's are. They are just hourly workers doing what they are told. Nothing more or less despite what they might think of themselves.

When you permit the search be it imaging or "pat down," you have given up your 4th amendment rights to an individual who is a government worker but that doesn't have the authority to deprive you of them as in the case of a LEO assuming probable cause.

The real question is, where do we draw the line? What is acceptable as it relates to your rights?

I will say that based on what I've read but not experienced, the new "pat down" term used by the TSA and the media is more akin to a frisking.

Frisking is reserved for an individual under arrest..........

I blame Bush for this mess and I blame Obama for this mess. Bush was seduced by the neocons while Obama installed a woman who seems to be auditioning for the remake of 1984. What makes Obama's view so surprising is he claims to be a civil libertarian. Didin't he rail against these tactics when they were conducted by Bush?

The whole situation is sad commentary on how government has become far too intrusive in our lives. Under the fourth amendment, we cannot be subjected to unreasonable searches and seizures. What is reasonable about this police state move? Does buying a ticket automatically mean the purchaser is now considered a terrorist? I though probable cause was needed before searches like this were to be conducted.

Obama's presidency is floundering right now and moves like this are only going to hurt him more. If he wanted to get back some of his popularity, he should immediately fire Big Sis and can the dope running the TSA.

The concern being that if anyone could enter in the screening area and undergo some amount of screening and depart at their discretion they could be considered attempting to test the security effectiveness.

An individual or group could place a variety of items on the conveyor belt, depart security and have another person in line (who is clean) observe the outcome. By the time the screeners tried to track down the owner of whatever item, they'd be long gone. Same goes for walking through a metal detector, see it go off, then depart security, etc.

With enough people, you could probably easily profile individual screeners as well as the performance/calibration of equipment at individual airports, etc. Similar to how people used to (and probably still do) profile equipment and staff at casinos.
