How does Delta staff transatlanic OE flights?

How does Delta staff transatlanic OE flights?
Someone please explain how Delta staffs a north Atlantic 8hrs +, flight with a third pilot when line check airman is conduction IOE or OE. Does the FAA require you to have a 4th pilot so when the line check airman goes for his break the OE student takes a break as well- thus always having two current, qualified pilots on deck?

For TOE, one of the other FO's is released with pay. (The senior one is given the option of staying on the trip.) He is usually notified the night before. In any case, the flight operates with a total of 3 pilots.

How is it technically "legal" to have a pilot who is not signed off yet to be on the flight deck with another FO. (not the PIC/Checkairman)?

Anyone at Delta care to comment. Didn't intend to bring our debate over here. Just looking for answers from a DELTA pilot.

Is a LCA @ UAL allowed to go to the bathroom while giving OE to a new hire. That would result in zero qualified pilots on the flight deck for lets say 10 minutes if he ate at Taco Bell for lunch.

FWIW, a Delta pilot doing TOE has already done OE and has been signed off prior to doing his 2 TOE's.
