Can the East guys make the argument that that SLI was made in agreement with an entirely different union and that it is in effect void?
Finial, binding and accepted by management and both parties. Yes (maybe). But now one of the parties - actually two of the parties - are no longer in existence. So, now what?
If I'm asking, you can best be assured that the East guys are asking the same question.
So, no flame cause I don't care. I'm really just asking what you guys have heard.

One thing I know is whatever it takes you two sentences to explain a lawyer can dismantle in 3-5 words (sometimes 2, in Latin)....
....and I'm pretty sure USAPA is not using their dues money to set up a safety committe or to manufacture cool USAPA pins for their ties.
Ask me about how we were supposed to get a 3% snapback pay raise in the 90's. It was right there in black and white. We got it, but it wasn't easy.
As of now, I don't have a paddle in the US/UAL merger boat. So, the list is all yours, I have no preference.
Good luck to you though.

Attorneys will argue anything they're paid to argue -- doesn't mean it's correct, or that it will prevail.

Sounds airtight.......until someone opens the lid.

I hear you, but the west pilots have formed an organization called awappa, we have retained two law firms to litigate usapa, one for civil damages, and another for rla stuff, and btw awappa already has more money than usapa in the bank, so we will see.

alpa policy no longer exists at US Airways. Good luck. THe lottery win is over. ALPA merger policy was not heeded, windfall, career expectations etc all thrown out the window. AWA should feel lucky, as Parker said without the merger, AWA would have downsized and furloughed about 20%. So much for a success. You can view this on the HUB, rather than listen to inaccurate information from Johnny Mac.

I hope that US and AWA are able to act professionaly, and let the lawyers duke it out. Viewing the PHX meetings on youtube, looks like the west boys are just that. Shouting, interrupting, making clicking noises like kids on MTV. Nice group! youtube was also edited and shows the west views. too bad the truth gets covered up. I don't see any good coming from UAL, but they had over 2,000 cards sent in last year to decertify ALPA. The root cause is that ALPA does not follow it's own merger policies, and that is largely why there is such a mess at US Airways today.

Flyharm, I am just curious. Have you read all the binding arbitration ruling between AWA and USAIR. It is interesting reading and I suggest you look the entire document over. The arbitrator goes into great detail about following ALPA merger policy and why he ruled as he did. The list is now the legal seniority list for the combined operations and would be used for any future mergers. Overturning a binding arbitration ruling is harder then overturning a court decision. The lawyers will always tell you that you can't lose. I have been through two mergers and they said that in both and in other mergers I was not involved with. In the end they walked away with lots of money but never changed any seniority list.
