That's exactly what you can do. An injunction is not a court ruling. Mesa basically said "We have a contract. DAL can't just cancel on us." Mesa was right in that aspect. So the judge said "okie dokie go out and get documentation proving that and come back and see me in Feb."
That's all. There has yet to be any determination of who is right or wrong. All they did was have a "pre-hearing" to see if it was even worth going to court over. Mesa will crumble one way or another. A company that can't even pay it's notes doesn't stand a chance against the biggest airline in the world. |

I suspect that DAL has all the evidence they need...when I worked at MAG my observations led me to believe that operational performance numbers were generated by falsifying OOOI times. It would not take much effort to document that if DAL cared to do so. The injunction was granted because MAG would liquidate without the DAL flying, not because there was any merit to the case. MAG will need to show some merit at this injunction hearing. On the bright side, MAG stock is up 23%! Unfortunately that is only $0.03 :rolleyes: Using JFK as an excuse is absurd considering that a considerable amount of Freedoms ERJ ops were out of MCO during the time period in question. |

DENpilot, I know that you hate people telling you that your employer will fail because you are on the other end of that statement. However, mesa is stuck between a rock and a hard place. They can't file BK because they'll lose their flying and yet they still have to fight until the very end which will ultimately mean liquidation because they keep losing 20-30 million every quarter. I feel sorry for the pilots and I would be alarmed that JO seems like he's taking this very lightly and that it's business as usual at MESA. I know it's a public company but still.
