Accrueing seniority while on furlough
 
At ASA do you accrue seniority while on furlough. I read the contract and it seems that you do. I just wanted to make sure I was understanding it correctly. If so, does that mean when I get recalled I will pick up on the pay scale where I would have been had I not been furloughed? Thanks

If it's anything like Comair, then furloughs accrue seniority (i.e. your spot on the seniority list,) but not longevity. Longevity is what pay is based on, so the answer is probably no. You will not go back to the pay scale you would be at now.

When you are furloughed you are worthless to the company, you don't work for them. Why would they give you longevity? The only thing that connects you to them is the seniority number you keep. When I was given my recall notice the CP said that I would even be under probation since I was furloughed before the 12 months.

This quote is a little odd to me. It is hard to actually know what the contract says since I don't work there. From the quote you posted it sounds like all furloughs accrue seniority, and then you would accrue longevity while on furlough and receiving pay in lieu of notice (whatever that means). You can clear this question up real quick by calling you're local union rep.

Sounds like you accrue seniority and logevity until recall...if you pass recall longevity stops.

It is really poorly written. Pay in lieu of notice is what you get per the contract if you've been at the company for more than one year and they tell you one day you are furloughed. For most it is 30 days pay. This is what they can do instead of giving you 30 days notice. If you've been there longer there are longer periods they are required to give you.

So what that quote says about longevity is that if they don't give you the required days of notice and opt for pay in lieu of notice, you still accrue longevity for the period that they have to pay you.

Negative.

§23.A.3 paraphrased says that people who have >1 year longevity are entitled to 30 days of advance notice (which the original 80 received even though we were not entitled to it) or could be furloughed at any time without notice, as long as pay is given for 30 days after the notice. Or it could be a portion thereof eg. 10 days notice and 20 days of pay, 1 day notice and 29 days of pay, 24 days of notice and 6 days of pay, etc.

§23.A.6 only guarantees 30 days of longevity from the day the furlough is announced.

For example, if ASA had announced the furlough on March 31 effective April 1, you (if >1 year) would accrue longevity through April 30.
