If you are otherwise eligible they can't deny you because you were on mil leave. Since it's an unusual situation, you might have fight the battle though.

If I read the preferential hire LOA correctly, it said active pilots not on leaves... could be wrong, but I'm pretty sure I read that.... and it is NOT the same as having your job protected while on military orders. Your job IS protected, your job is at Eagle... not at AA. To be eligible for preferential hire, you need to be active, not on leave. IIRC.

They should have written it better, but it's ALPA after all... and the APA wasn't invited to the party (talks) so nobody thought to protect our military folks (IMHO had the APA been there you'd have been protected)

The "active pilot" requirement applies to the "protected pilots"; PPs are all those after the 824 slots are awarded.

Not sure about any requirement for the 824, which it seems you'll be a part of, assuming you don't already have a number.

Only part of the 824 if he is a Captain, or has held CA previously.

You are also supposed to progress on your job while on Military Leave, AMR is calling this flow as carrer progression!!! It will be interesting to see!

i would call amr hr and alpa ae mec and tell them that you feel discriminated because you serve to protect your country and amr and alpa is penalizing you because you are on military leave in the service of your country.

that should get you an answer fast.

It would just take the first person to bring it to court, considering that probably most military lawyers would jump all over this as well the media, I don't think it will be an issue (the biggest hurtle is having the flow actually happen)
