The Meeting is tomorrow, and the forces of Dark Side have been working overtime (on our dime) collecting proxies to try and defeat this.



The below is for your reference and need not be attached to your proxy form:



CONSTITUTION AND BY-LAWS PROVISIONS ON PROXIES FOR LOCAL COUNCILS

Constitution and By-Laws Article III, Section 3G, Proxies: "Proxies for a Local Council meeting must be in writing, from an Active member in good standing, and for the specific subjects listed on the published agenda. Stated on the proxy must be the name of the person issuing the proxy, the person to whom issued, and the subjects covered by the proxy. No member shall be able to vote more than three (3) proxies. Proxies may be used in any vote by secret ballot in a Local Council meeting except those votes enumerated in Section 3E of this Article." Article III, Section 3E, Voting: At all meetings of a Local Council, all questions coming before such Council shall be decided by a majority vote of the Local Council members in attendance (including valid proxies except as provided in the following sentence), and each Active Local Council member in good standing shall have one (1) vote. Proxies may not be used for secret ballots required in Article III, Section 2E(3) (Interim Status Representatives); Article III, Section 7A(1) (Nomination of Representatives); Article IV, Section 2B (Strike Votes); Article IX, Section 7B (Assessments), and ALPA's contract ratification procedures.



Interpretation of the Executive Council: The Executive Council, at its December 2000 meeting, interpreted Article III, Section 3G as follows: “Proxy forms under Article III, Section 3G of the Constitution and By-Laws must be completed in their entirety and signed by the member giving the proxy, including the name of the proxy holder, when the form is signed.”

Herb WXXl (the original snack packer himself) is sending out text messages to DFW pilots lobying against recalling Tony & Dave. Here is what he's sending:





Since he is sending it out to DFW pilots without their invitation, It's copied and pasted below exactly how he is sending it out.






"Hope all is well. I know everybody likes to stay away from things like this, but I would like to ask a favor. Val and Kelly are having a meeting this Wednesday of LEC 83 at the Hyatt at 1:30 mainly to pass resolutions to recall the MEC officers (Tony and Dave), the communications chairman (Jared), and the SPC chairman (Hector). Their motives are purely political, they along with HXXb Mark, Bxxl Spxxxue, Phil Vaxxxe, and Sxm Pxxl are working to take control of the MEC so they can change the direction of the politics of the MEC, even if it means lying to achieve this. This group has said many times that they want to fight the company, under their direction we all would have spent tons of money in court in order to eventually take pay cuts, vacation cuts, hourly cuts, and much more. I say this based on the APA losing their case against the company in bankruptcy court. Instead the thought process was to be creative with our options up front rather than the other options. Tony and Dave end their terms this August and both have expressed they will not be running again, so a recall 4 months from the end of their term is nothing but a waste. If you are available I would like to ask that you go to the meeting and vote against these recalls, for the pure reason of not letting LEC 83 be a part of personal agendas. Val has said many times that LEC 83 wants to fight at every turn. After flying with so many pilots at DFW, and talking to so many at the PUB events and Family Awareness event, this is just not the case. The pilots are reasonable and want to ensure their careers are taken care of. These gentleman have a personal agenda and are not interested in protecting jobs and quality of life. Kelly published a letter that stated he wants all negotiations to be stopped until expenses are discussed. That would mean that being able to negotiate the most pilot beneficial PBS system would be in jeopardy of being just another PBS that we are un-happy with, AQP which could be a very big and positive change in training here at Eagle could be more of a jeopardy event than it has to be, and Eagle pilots could be put in the back seat regarding merger talks in the AA US Air merger. Which could jeopardize quality of life dramatically.



I was personally very proud of being a part of the events of last year. I call it the best – worst experience of my life. It was hard, but very rewarding to be able to ensure that the pilots were able to get the avenue they deserved to have access to information. I was very happy to be able to provide both the pilots and their families a chance to see that they were not the only people being affected by being part of a bankrupt company. Val, Kelly, and this group did not want the pilots to have this access. They fought it at every turn. I hate to see these petty politics to be what the past year is what this is all about for some. We have a great group of pilots here and Val and Kelly want everybody to think that we are not. I personally am ok for recalls on truth, but the things that are being said are full of lies…for example, I’ve had FO’s ask me how Tony and Dave arranged to be in the first new hire class at AA – they haven’t and they can’t.



I apologize for this being so long, it is amazing to me that so much hard work by volunteers doesn’t matter in any way shape or form. Please let me know your thoughts and if you would be able to help me. Also, if you happen to speak to anybody and they can also come and help stop this idiocy let me know. My motivation is about righting wrongs, my role is still as your Family Awareness Coordinator. Communications and ensuring truth is relayed is very important to me.

Okay, I did edit it... I removed his phone number. Even I'm not that mean. Yep, the receipts are all lies. The ALPA policies aren't written in black and white. You guys didn't missapropriate large sums of money. Oh, and from where I sit, the APA did a hell of a lot better than we did, and they still are. These guys thinks scraps from the table are a Kings meal.... they've been beaten down so badly that when the beating isn't as bad as the last one, they call it a win. They're friggin nuts. This maddness has to stop.



Guys, get to this meeting and vote, or get your proxy carried in.

Yes, they have till the end of this week to pay up as per Alpa National.

A big morale booster for this pilot group.

If that's all they have to pay, it's a drop in the bucket and they're getting off easy. Perhaps someone should phone the producers of American Greed : Scams, Scoundrels and Scandels and clue them in on what a great episode an exposé on AE ALPA would make ?

What I'm hearing is those were the only receipts sent to national. They were from a one week period. So if that was one week? How much do these guys really owe the union back?

Somebody said there were more receipts; and that all if these were found during a half day visit to the finance department. Maybe you guys should go back.

I doubt this was a one week loss of control at Eagle ALPA. I'd lay strong odds the $$$'s would be dozens and possibly hundreds of times what this little snippet reveals. Considering these people have been in power for years, I wouldn't be surprised to see the financial malfeasance break the six-figure level. The stories I've heard are not just about the leadership turning union funds into their personal piggybank of excess, but alleged attempts to cover it up and/or impede the persuit that followed after it was revealed. The stories being told are truly disturbing if true and supposedly there is a possible criminal investigation underway, but not sure of the specifics as the person alluding to this cannot divulge details. If there is criminal wrongdoing, I hope accountability results. At the very least, I think it's just another example of how out-of-control ALPA has become as a responsible organization and IMO, they can now add a complete lack of oversight of their MEC's to their list of obscene faliures. Aside from requesting repayment of what's been found so far and apparently cutting off union funds to those implicated until that is accomplished, ALPA nataional has obviously made no attempt that I see to have them removed from their positions, which is shocking considering what might be below the tip of the iceberg if someone is willing to dive a little deeper.

Disgusting from stem to stern, it is.

ALPA national doesn't want to delve too far into things because it knows the excesses of the other MECs are even worse. Just so happens EGL mec is specifically banned from buying booze so they got busted for doing something that is completely normal for all the other MECs.
