Hmm maybe I'm the only one reading this thread anymore
but after writing a lengthy email to AFPC regarding the VSP Payback in the event you get an AGR position (not when/if you retire, but when you get in), here is their reply (FYI: I signed the original Attachment 11):
"The General Counsel has reviewed the applicable laws and determined
that a Guard AGR position does constitute active duty and would require
recoupment of VSP as detailed in Title 10 USC Section 1175a. GC has
also reviewed and approved the revised Atch 11. You have the right to
request withdrawal of your VSP separation based on the late publication
of this guidance. I cannot make a determination as to whether your
withdrawal would be approved, but if you are interested, please submit
your request via a memo through your MPF."
I also inquired about the TRICARE benefits (arguing the USC points from my last post) but the USAFR Maj did not address those in her reply.
Does this mean we are pretty much out of luck for AGR positions? FWIW, Title 32 specifically states that Active Duty does not include Full-time Guard.
Getting frustrated here. Is the General Counsel just ruling in favor of whatever will save the USAF from paying the VSP??
