The review of ALPA merger history over the years has shown that while ALPA policy WAS considered, in most, if not all mergers, the arbitrator has gone beyond ALPA merger policy in determining what is fair. Review fridays testimony.
You guys keep bouncing back and forwards. You want interpretations to go all your way. You want to include outside factors when it benefits UAL, but not CAL.
When LUAL lawyers present their list we'll see how FAIR you guys are being. I am sure you will strictly adhere to your version of ALPA policy. I am sure that UAL version of the list will be the exact opposite to the CAL list with supporting evidence from your experts. Maybe then we can stomp and hold our breath and shout how unfair the list is.
How much of this positioning goes into determining the list remains to be seen.
So, you think it's FAIR that , absent a merger, I'd have been in the top 8% of the seniority list at retirement, but with the proposed CAL merger list I'll retire at about 40% up the list ? This is not unique to ME .. this is the situation for about 3000 UAL pilots hired '96-98 that were never furloughed. Is that YOUR definition of fair and equitable? That with 16 years of sweat equity contributed to the enterprise, my career expectations will be destroyed? Just yes or no, do you think that's FAIR and Equitable? Originally Posted by CleCapt

Inequities such as these transcend ALPA merger policy and are actually covered by the Bond McCaskill Act.
