Don't worry about the IRS/ Go after your money/paychecks! I am not familiar with the details, though if they are operating under Chapter 11 reorganization it gets the creditors off their back but they are required to meet current expenses; that includes payroll! I was in a similar spot once with an aviation company. I discovered later, the jerks hired me with no intention of paying me, a chapter 11 deal... I found out months later that I was the only person, out of about a hundred, who got paid! About three days after payday, I went to the office with my best "don't screw with me" look and demanded my check. After listening to their BS for a few minutes I again demanded my pay and informed them that it was about to get real ugly if I didn't leave shortly with my pay. They cut my check and I was in the bank in less than 10 minutes hammering it.

Please don't wait around for your pay. Go after it with the fangs out, and now!

No one is cheering for the out of work pilots, I was one of them.
Many pilots walked away when they saw what was going on.
Many pilots were fired for speaking out.
Avantair purposely damaged pilot careers and reputations for their own benefit.
The pilots knew, the owners knew, and the Faa knew.
It was just a matter of time, and now the "Piaggio" has come home to roost , and there is surprise. ??

I agree with this. Its important that the employees at Avantair stick together, stay in touch with each other, and research their options. Strength in numbers. I would start by contacting the local state labor department. They can't ignore 500 people, all with the same complaint. Management is hoping and assuming you guys won't put up a fight.
Don't give in. These slime balls knowingly strung you along with no intent of paying what you are owed. That's dishonest, misleading, and out right fraudulent.

Avantair's troubles mount: Employees furloughed, fleet grounded

Thalji, 6/26/13, Tampa Bay Times) The future of fractional airline Avantair grew dimmer on Wednesday when the company reported that it is furloughing pilots and workers, needs additional financing to start flying again and is even in danger of having some of its planes repossessed. On top of all that, the company also became the target of a class-action lawsuit filed in Oklahoma this week that could be joined by hundreds of other plaintiffs. Avantair employs around 500 people and operates out of St. Pete-Clearwater International Airport. It allows customers to buy shares of the company's fleet of private planes so they can schedule flights when they want to fly, skipping the hassles of commercial air travel...

I'm sure if the CEO sells his yatch and vacation house in Aspen, Avantair can pay most pilots what they're owed

Reality is that the CEO's personal assets can not be touched by the anyone....UNLESS they were pledged as collateral....highly doubtful
Scumbag...yes.... will his personal wealth be relevant legally? ( not morally mind you) .... highly unlikely.
