I read it. Seems like another person taking deep huff of copium and sunk cost fallacy. Just like the Yet Another Value guy and his lawyer friend Lionel Hutz. No way the first circuit court reverses the judges decision.

This guy was also posting in depth analysis on why the merger would pass on airliners.net. We all know how that went…

We can rationalize why it should/shouldnt pass but it still comes down to 1 judge who might not think the same way.

Federal appeals are usually a randomly selected 3 judge panel of the entire court of appeals. Occasionally these are then appealed to the entire court of appeals "en banc". Those are typically an unusually complex or important case.
