Sounded like the lawyer has read the FARs and possible their FOM about captain authority and simply connects two dots. Captain is in command then captain is responsible. He said more than one can be at fault so he's pulling as many into the suit as he can.

Some captains all of the time, and all captains some of the time, have sat up front oblivious to the goings on of the boarding process. I suspect the "some" will decrease. |
I saw speaking in the context of what the attorney was saying. Yes, we can decline someone intoxicated. But he was speaking of the captain to stop or moderate the altercation of the airport police and his client. Are you kidding me? He was belligerent, rude, and non compliant with the agents. That escapes me and doesn't jive with the post 9/11 strategy. So now when someone starts screaming and demanding for more pretzels we are supposed to get up and watch said individual to make sure punches are not thrown.

once United CSR's called police and had that Captain in Denver arrested for trying to allow a jumpseater to bring his bag into the cockpit, I backed completely away from any dealings with issues during boarding. not even PA's.
if the senior managers in ops ever want to bring back the Captain's authority of old days, they can. for now, they've taken it away and they can keep it |

This incident is clearly a matter encompassing perception of entitlements. Since he was a doctor and has allegedly four patients to see the following day, the airline should skip him and pick the next unfortunate. This makes me sick that people still think this way and are always exceptions to the rule. Anyone catch where the attorney answered a question regarding the voucher amount offered? The press then asked how much more would they take in hindsight to take another flight. $3000.

Who UAL chose to fly the tin can has nothing to do with this. Which scheduling tried to PS a crew at the last minute and displace pax after the boarding? Who did the crew work for and which major was the trip they were trying to make supporting? This got the ball rolling did it not?

The ticket says "United" but ...if the legacy is legally responsible for the contracted carrier then it makes less sense to even have a contracted carrier since you have to control the quality of product yourself ... it would make more sense to just own the contracted carrier to control the product.
