Here is a twist that I think could possible happen.
Gary Hummel has no where to go when APA takes over. He does not hold a FAA 1st class and can not return to the line. Hummel acted like a company salesman in selling the MOU. What is Hummel's reward for selling the MOU? Parker promises Hummel a management position. Hummel presents the NIC to APA as the list. Who can stop Hummel, not the BPR. |

Ok, so let me get this straight. For the last eight years the east pilots have done everything in their power to avoid implementation of the Nic award, including not getting a new contract. You guys have given up tens of thousands of dollars worth of raises!!! I'm a 75/76 FO and I make more than your A320 Captains. And you guys are criticizing the west pilots for helping to fund a lawsuit that fights your rope a dope, trickery? You guys need to sit down with a calculator and look at like equipment pay scales of your peers and get a grasp of the money you guys have urinated away over the years before being so vocal of your criticism for the West Pilots. The APA has got to be wondering what they've gotten into here. Good luck, all of you. Life is too short to spend bickering, gloating, and treating others this way on these boards. |

Your point about the calculator is well taken, but a little off. With the Nicolau wedge, a DL contract wasn't available to us. The Nicolau award turned us against each other and you can't get a good contract with that situation. What was available was the Kirby proposal, and it wasn't worth taking the Nic for. It really was simple math and trust me, my calculator has been used a lot. USAPA tried to renege on binding arbitration, but failed. That point seems to be lost on most posters. We do not have an east/west DOH list. USAPA may propose to combine the 3 lists that way, but I give that zero chance of success. What it did do is allow the JCBA provision of the TA to keep the Nicolau award at bay. It came at a huge cost, but obviously both sides thought it was worth it, or we would have tried something else, right? It didn't have to be that way. If we had better leaders at East ALPA, West ALPA or ALPA National, maybe it could have been different. We didn't and it is what it is. Each side made it choices. The east had a lousy contract, but benefited from it attrition. The west had a better contract, but has stagnated. IMHO it was stupid of BOTH sides. Along came the merger and the situation changed. The company now wanted something-the east's scope and the selling point of a theoretical "labor friendly" merger. AA management was using the east/west seniority fight against Parker. So it was now willing to pay more in exchange for not having to get around the change of control and code sharing provisions of the EAST contract and convince the UCC that the SLI wouldn't be a problem. The offered the MOU with the new payrates(that didn't happen in the US/AW merger, they kept us on LOA 93), and the MOU said that all previous agreements were null and void. That included the TA where the unimplemented Nicolau award resided since it was never implemented. Obviously it was not in the MOU or there would have been no reason for the DFR (Humel testified via deposition that it was the company that said they would not settle the east/west fight in the MOU. The judge didn't allow his testimony, but it's there and AOL could have called Kirby to counter it). We ALL voted and overwhelmingly approved it. The west was trying to trick F it. They were voting for the MOU thinking that it would trigger the JCBA provision of the TA-it didn't, it revised the TA. The judge decided she didn't like what has happened, but couldn't rule a law had been broken. That's the way it is, but what now? Move on and try to get the best under MB with AA, or keep fighting in the courts? I see no change in attitude from the west and expect a new lawsuit or appeal as early as tomorrow. We'll have to see what the company and the APA do. Will they live up to their contract, the MOU? IMHO this will cost ALL US pilots in the SLI with AA. We'll see, but you are correct, nobody has really won except Doug Parker. Our food fight has allowed him to benefit personally and professionally. One of the components of our management bonus scheme was tied to the containment of CASM. Our fight provided that wonderfully, lining the pockets of Parker and his buddies. It put him in a position to run the largest airline in the world. We've just dealt with a bad deal, the Nicolau award, the best way we felt we could. East and west, and if you haven't lived it, you probably cannot understand it. |
