Usapa doesn't represent any usairways pilots as of today, all funds should be returned to all pilots east and west. What the former union is trying to do is use union funds to represent east pilot interests, that's illegal. The west sent a letter last week to every usapa officer that we would be pursuing criminal charges against them should they attemp to use union funds when they are decertified. This action filed by usapa is a preemptive strike to muddy the waters and start the transfer of pilot funds to usapa's lawyers

Wow, some true colors coming out here. The AOL web mafia is in full force, they have been quiet for awhile getting their story straight.

As ackattacker plainly laid out, the HUGE windfall the West guys would get with what they want. They have looked at it and have found even greater fortunes if they can force the NIC, in combination with the AA pilots. Hence why the full force effect to try and down play what the NIC would have in this new 3 way.

They are on the hook for 3+million to their lawyer, you bet they want part of their 10million back instantly, once again I think they will be surprised with what they think will happen and what reality is. Once again they will call all the east pilots Scabs, among other names and yell at us as the reason they are stuck in PHX........

They were offered the NIC, their lawyer explained the gamble to them, and that they held all the RISK. they rolled the dice, and shortly after LAS was closed, and the east had to transfer 25% of the flying to them to maintain the PROTECTIONS the east negotiated for them..........

ackattacker Is plainly wrong. Not every west FO would be captain with the Nic in place. That's just more erroneous propaganda you east guys like to use. I think it helps you sleep better at night.

It is however, a very nice thought. But then again, so is the thought of letting the east go into liquidation and each of you working at home depot. Wait...never mind. I like home depot. That would ruin it for me.

Ok how is that propaganda? By the NIC list every west f/o can hold grp II capt. With a no bump no flush, true there isn't enough capt positions for 800 west f/o's to go to capt immediately, but they could argue for ghost positions to be put in that the next 800 capt openings be subject to first refusal by all the West f/o's wouldn't be the same as every west f/o taking every capt seat, but would dramatically effect the progression of ALOT of other people.

Funny thing is, as Parker laid out, we might have gone into liquidation and working at home depot, but we'd be sr. to you again as we would have been there longer as your furlough was coming shortly after our liquidation. See how crystal balls work?

Usapa has no legal right to keep that money, they are only allowed to shut the union down. Notice they filed a "state" action and not a "federal" one? $3.3 million of west pilots money they are holding while not representing us.

AOL update
Today, the NMB certified the Allied Pilots Association as the exclusive bargaining agent for all flight deck crewmembers of US Airways. You can read the NMB determination here. Effective immediately, USAPA no longer has the legal status of a collective bargaining agent.

USAPA is still in possession of a substantial amount of dues monies, collected from US Airways pilots for the purpose of collective bargaining - a purpose which they cannot fulfill anymore. A demand letter was sent on Friday September 12th to USAPA officers and counsel which notices USAPA for the remittance of all funds in excess to concluding USAPA's business as a exclusive bargaining agent required under the law. You can read the demand letter here.

Additionally, a Litigation Hold Letter was sent to USAPA attorney Brian O’Dwyer for the retention of all USAPA records.

Finally, we encourage all West pilots to apply for membership to our new collective bargaining agent. The APA has a convenient online application, which you can access here.
