Yeah, but if he got another job, then couldn't they increase the payments since he would be making more money in their eyes?

I think he's better off biting the bullet and hiring a lawyer and fighting it then just getting another job.

...and a word to the wise to my fellow un-married pilots...remember the "5 F's"...well...I would stick closely to that rule of thumb...

There are too many responsibilities you take on on behalf of another when you get married....but yet fools still scamper for it. I am crazy about my fiancee but I'm not crazy about the way the law is set up when it comes to marriage.

Yes, they could consider that income IF they go back to court to recalculate.

But my point is that he may need to get a second job to meet the responsibilty he took on when he brought two kids into this world. If they reduce the child support down to his guarantee, assuming that is a ratable reduction from the 160 hours per month to his 75 hour per month guarantee, he's going to be contributing less that $500 a month to raise two kids. That does not go very far unless you live in a very low COL area.

Second job needs to be off the books...bartender, waiter, part-time construction. That's the only way to get around it. Almost everywhere in this country when couples split the man gets hosed. :mad:

I know in NY if you hire someone you have 90 days to submit his/her name to the state. I think it is everywhere now.. Part of the I-9 paperwork, but I may be confused.

Bottom line, you get another job when the first tax roll is submitted to the state you will be caught anyway. Many states troll the bank records, boat, house and other sizable assets looking for people who have more than they are admitting to.

For a few years, every October, my ex's state seized my bank account and took the funds (the magic number was more than $500.00). After the first year, I knew when it was coming and made sure never to have more than 2-300 in the account. They are allowed to do that under law, if they can do that, they can find where you work and how much you make.

for the comment about COL and short changing.. no where does it say the father HAS TO be the SOLE supporter.. that is so archaic these days. More realistically is the right to survive with some dignity and anyone who has been the courts knows what I mean.

It is unfortunate that divorce happens, however, it does happen.

Have you thought of obtaining custody? Then she would have to pay you child support.

It's probably going to be an impossible battle to gain custody when you're on the road for 18 days a month... You can't exactly pack your kids into a suitcase and take them to the Holiday Inn Express...
