Default 709 Letter

I got one of these certified letters from the FAA. I had a low pass rate as an instructor (2 of my first 3 ever students failed first time).

The letter doesn't state what I'm being reexamined on specifically. It just mentions the "appropriate areas of the PTS." It said nothing about needing an airplane.

When I got the email confirming the date it said to, "please let us know what type of airplane you will be bringing." I called for clarification and they just told me to "bring a plane, it would get ramped, we'd fly for awhile and that I'd be given a sampling of the instructor PTS in ground." Nothing specific. Is this the way it usually goes for these type of 709's?

Call a lawyer before you speak another word to the FAA.

And, thus, aviation has sunk to a new low.

Keep all documents regarding the 709 ride .Down the road you will need to explain to future employers why you had a 709 ride. I dont want to depress you but I know someone who had a 709 ride because the FAA investigated his DE for not doing complete check rides . .A question on Airline apps fior Pinnacle asked specifically if he ever had a 709 ride . Thinks it flagged his app he never got a call .

He eventually got hired elsewhere and was able to explain the situation . In your case it can all be explained so KEEP ALL PAPERWORK!!

Been there for a long time. You can go it alone when dealing with the government when its checking on you or have the assistance of a professional.

Doesn't mean you'll get out of the ride - a lawyer will not generally be able to help much there. But it might help in terms of knowledge of the lay of the land at the FSDO and the ability to at least negotiate the scope of the reexamination.

wouldn't make too much sense otherwise. Sort of like hiring a plumber to fix your lamp.

This is why you call a lawyer:

Also never talk to the police (this is actually a pretty funny lecture)

A former FSDO and I were having dinner the other night and we got into this discussion of investigations. I asked him exactly how he would handle a phone call inviting him to have a discussion with an investigator. He said that he would make up some excuse as to why he could not speak at that very moment (even if the *excuse* was because he needed to review the facts in his head) and then immediately call an Aviation Attorney who's first act would probably be to draft a letter to the FAA directing them to make further inquiries through him.

Sounded like pretty good advice.
