Under the advice of counsel, I refused to take the exam until I was given a Letter of Notification that was written within the guidelines of 49 USC 44709. They agreed and a new one is on the way.

I tend to disagree with the LOI, as this is one more deal you'll need to explain to prospective employers. Read through this thread, if you haven't already. The outcome is very positive, as the FSDO followed the thread on APC:

What LOI are you referring to? And which explanation to prospective employers?

Sounds good.

...and, also ask your attorney if it's ok to update a group on a publicly-accessible forum before the episode is completely over.
