709 Ride

Default 709 Ride

I had one of my former students get into a non-fatal, but serious accident about 7 months ago. As such, I picked up my notice of a 709 ride today from the Post Office. My current military aviation training environment forbids me from flying outside of the military curriculum. So, I am not in a position right now to take a ride with the FAA, and I am talking to a lawyer (thank you AOPA!). My question is, if it turns out that I have to take the ride, who furnishes the aircraft, Me, or the Feds?

Also, if there are any other CFI's out there who have had to take a 709 ride, any insight you can offer would be most appreciative.

The 709 letter usually says that you furnish the aircraft.

Mine says nothing about it. It basically says call to schedule the ride and get more information. The FSDO is 4 hours away, there is no way in hell I am going to drive all the way up there and have to pay for another ride when I am in an environment that does not allow outside flying. I suppose this is where the lawyer will earn their money....

I had a student ding the tip of a propeller on landing on a solo flight. I had to take a 709 ride. We did the paperwork, and 10 touch and go's in the pattern. I had to furnish the aircraft.

You're going to have to furnish the aircraft.

Just a tip. A 709 is really just yet another way for a fed to feel good about himself. The purpose of the 709 is noble, but once you get there, its a "poop-on-you" fest. Your job is to sit there and tell them what you know about being an instructor and then nod as they tell you all the stuff you don't know.

If he gets the FSDO to retract the 709 ride without having you dragged through the emergency pilot certificate revocation process (which is what the FAA usually does when someone refuses to do a 709 ride), he will definitely have earned his money.

Well, let's be clear, here. I am not refusing it; there is a Major General that says we can't do any outside flying while we are in training. So, there is at least one extenuating circumstance that is pretty valid.

Try to get the FAA to defer the 709 without certificate action. Maybe you can agree to not use your FAA certs pending the ride?

You are in a hard spot. You don't want to tarnish your FAA record, but you don't want to wash out of military training either. I'm sure the military would give you permission to do the 709, but you sure don't need the distraction (or to waste time preparing for what will effectively be a CFI checkride).

The military is a better flying job than entry-level civilian gigs...I'd give up my FAA certs before I'd blow military training. Besides, when you complete military training you can get an FAA CPL...maybe the feds will consider completion of military training as adequate penance.

Title 49 USC Section 44709(a) is the law that we are talking about here.

I would suggest that you ask the FSDO if you can place your Flight Instructor Certificate on "Temporary Deposit" at the FSDO for up to 30 Days. This may buy you some time. Ultimately you will need to submit to the 44709 Re-Exam or possibly face Suspension of your CFI Cert Pending Compliance with 44709. Google FAA Order 8900.1, Volume 5, Chapter 7, Section 1 for complete details.

You might provide a copy of the policy letter from the USAAVNC with a copy of your orders. Also, the fact that you can only get passes on the weekend might deter them. ;)
