............essentially requires payback if you don't eventually end up going to HKG (change bid, fail to bid, bid sideways, fail training etc.)

Of course you have to pay back passover pay if:
*you fail upgrade when you are finally sent to class
*refuse to go to an equal paying seat elsewhere if that is available first
*change your bid to a lower paying seat position and are awarded that

One issue was when do you start passover since NOBODY was training on the same bid (08-03). While all of us have plenty of opinions on what we think would be "fair", "common sense", or "contractual", the fact is it was a contractual gray area that had to be hashed out with a bunch of lawyers.
I probably pestered the legal team about every two weeks about the issue since last May. They have been exceedingly patient during some frustratingly slow negotiations, and have put up with my barrage of calls and emails with grace.
For details on the hows and whys, I strongly suggest you do what the Message Line suggests and contract Coy in Grievance or the legal team. They can answer your questions with the details you want.
