I think the key to Tony's argument is the phrase "normal practice". There's no question about an individual PIC's authority to deviate from the normal practice for a "reasonable reason", but if many PICs suddenly start doing so at the same time, a judge MIGHT call it a prohibited labor action in violation of the "status quo" rule. One did just that at Delta a few years ago (in the matter of an unsanctioned no-overtime campaign), issued a bunch of individual subpoenas, and ordered the union to put a stop to the campaign, which they did. I think it was a true "grass-roots" effort and that the judge may have been wrong, but that's what happened.

If it could be pulled off it would work. But it is so stupid of an idea at this stage in the game that it does not even warrant discussion. We can't get guys not to draft and volunteer, much less this.

If we were all still bopping around in Brasilias, maybe.
But the MD10 and MD11 are serious business when it comes to landing. We got some data points there. I need all the practice I can get.
By the way, George, this is a classic thread. Better than pulling up a lawn chair with a six-pack and watching a bug zapper on a summer's night....

I think you would get a lot more Captains to go along with this. They could do all the drf and vlt and still be helping the cause.
