Default SkyKing now Chapter 7 or Dismiss Chapter 11??

I need a little help here. I left SkyKing about a year ago but they owed me (for those of you who know this isnt a suprise) about 5000. I filed a motion with the bankrupcy court in Sacramento to collect on my money.

Well yesterday I recieved a letter from the bankrupcy court saying that they are motioning to covert to chapter 7 or dismiss the chapter 11 case. I have no clue what this means but I just dont want them to weasel out of any more of the money they owe me.

Does anyone know what this means? I heard their planes were parked yesterday and nobody was flying them.

Any advice on what this means would be helpful. Thanks.

The company is moving to liquidate rather than restructure. If you have the court clerks contact info, call or write to ask what your standing is as a claimant in the new Chapter 7 case and if you have to refile your claim.

I also got a copy of the letter. I called a few people that are still working at the King and they said that the company denies they are liquidating. It all seemed a little confusing. I wrote that money off a long time ago that they owe me.

So last night I'm at a Little League game and sitting with a dad-lawyer who I've had a few conversations about SkyKing while the initial bankruptcy was going on. I told him about the Chap 7 letter and the conflicting info from the mgt. He said its common in a bankruptcy for the court to solicit ghost bidders to part the company out to. He said the letter was part of the process. The court is just trying to get more money for the creditors.

It seems like sort of a Krap or get off the pot move by the court to MGT.

I was just offered a position in maintenance management by skyking. It seems to me that if they were liquidating they wouldn't be hiring.

HSLD thanks for the info ill be sure to do that this week. The king is so sketchy im sure they will try to do anything to get out of paying money.

PilotGolfer im not giving up hope lol. I saw too much with CS and KP that make me still wake up in the middle of the night. Im sure you can relate.

Turbo last I heard they were down to 3 planes including 870 but the word is the 767 is gonna happen soon!

JD if your out of work now id take the job but if you have employment id recommend staying away esp with the mx. Just look out for your certificates. They will definitely put them to the test

I currently work for Avantair. As bad as you think SK is, I feel it's a step up from where I currently am.

Just got off the phone with the Bankruptcy Court. They filed this motion against SK. Basically SK is not meeting any of their obligations so as Pilot Golfer is correct. Its poo or get off the pot time for SK.

I personally wrote a letter objecting to the dismissal of the Chapter 11 and urged the court to let SK go into Chapter 7.

Hers is a copy of that letter:

RE: Case Number 12-35905-C-11

To Whom It May Concern,

I am writing to state my objection for a motion for a dismissal of the Chapter 11 case against Sky King Inc. I was a former employee of Sky King and I am claimant #XX in the Chapter 11 case against them. I had the unique opportunity to witness firsthand their predatory management t techniques and complete disregard for the welfare of their employees. Promises were made to employees who worked hard to try and make this company a success and the management disregarded their efforts and in my opinion any attempt to potentially dismiss the Chapter 11 brings credence to this theory. They should be allowed to go into Chapter 7.

Unfortunately, I live in ***** and due to financial constraints I am unable to attend the hearing scheduled for July 17, 2013. However, in no way do I feel that this company should be allotted any type of relief for their poor management practices and they should hold up their obligations. If this was the first time they had filed for bankruptcy I would feel some type of relief may be necessary but after seeing the revolving door of bankruptcy motions and “sleight of hand tricks” to avoid paying their obligations it needs to be put to a stop and that time is now.

I am just a former employee and I just want what is fair for the time and effort I put into working for this company and it pains me to see all the time and energy wasted on attorney’s fees that could have been put to proper use to properly run this company and save jobs for many of their employees.

Sorry SK but its time to pull the plug.

As I understand it, they need to dismiss the Chapter 11 filing in order to convert it to a Chapter 7 liquidation. It's not that current management thinks they can actually pay all the bills. The court just thinks there is so little left on the bone it's time to give it up.

ORD, if your claim goes back to the Luekenbill days, it was discharged in the first bankruptcy in 2010 or 2011. I don't think the unsecured creditors got anything. Unfortunately, everyone got screwed in that deal. Greg called overtime per diem to save tax money. Unfortunately for the employees, overtime would have put them at the top of the heap to get paid - but per diem puts you at the bottom.
