It would definitely be illegal because this is a Section 6. Since DALPA knows so many pilots already suspect this, it'd be a high risk. Problem is that you'd have to be able to make the case to the Justice Dept. to investigate the third party vendor. You'd have to have a reasonable suspicion to get Justice interested.

There are a number of initiatives now of pilots recording their votes via a verifiable email. If those lists showed 80/20 against and the DALPA vendor vote comes out 60/40 for, that might be the evidence needed to launch an investigation. This particular topic is only going to get hotter as the deadline approaches.

Votenet keeps a total of how many eligible voters have cast ballots. There is no "in favor/against" running tally. The votes aren't tabulated until the voting window closes.
