Management just tried to tears 2 pay tables out of the PWA with the Dec. 1 pay raise. Council 1 thinks we should do something about that.

Council 1 Resolution

WHEREAS: Delta airlines has announced additional raises to non-contract employees of 14.5% effective December 1st, 2015.

WHEREAS: The raises are announced after a specific threat to circumvent the Delta Pilot Working Agreement section 3. B. 4. during section 6 bargaining.

WHEREAS: The timing of the raises are an intentional act for the purpose of avoiding a comparison on or after January 1, 2016 which would provide for a 3% increase in pilot pay rates.

WHEREAS: The frequency of the raises is unique and exceeds traditional annual raises resulting in two raises for the calendar year 2015.

WHEREAS: The cumulative amount of the raises are unprecedented at 17.5% or more for noncontract employees.

WHEREAS: The act of intentionally providing excess compensation allows management to forego future raises. The withholding of future annual raises will result in continuing to suppress pilot pay rates during negotiations.

WHEREAS: Suppressing pilot pay rates during negotiations allows management to maintain pilot pay rates at a lower value thereby enhancing their bargaining position.

WHEREAS: The intent of the agreement is violated. The intent being to link the recovery of pilot pay rates to internal peers within Delta Airlines and external peer pilots at other airlines. Concessionary pay rates given for mutual benefit and enacted by letter of agreement designed to assist in the financial recovery of Delta Airlines have not yet been restored.

WHEREAS: The spirit of the agreement is violated. The spirit being fair dealings in the interpretation of the agreement regardless of current events. The spirit also being the terms of the agreement, both implied and express shall endure until superseded by mutual consent.

WHEREAS: These actions are an attempt to influence negotiations and contrary to the status quo requirement of the Railway Labor Act during section 6 bargaining by limiting pay rate accumulation.


THEREFORE BE IT RESOLVED: Council 1 pilots direct the Delta Master Executive Council of the Airline Pilots Association to file a grievance on behalf of the Delta pilots to require specific compliance with section 3. B. 4. of the Delta Pilot Working Agreement on or after January 1, 2016 but no later than April 1, 2016 the date customary for non-contract employee raises.

While this is a long shot, the argument could be made! This is a very similar situation to when Delta sued the pilots over greenslip flying. A precedent had been set on the amount of overtime flying done by pilots and the expectation was that it should continue at that level. The company has set a precedent on when it normally gives raises and is now obviously changing the timing in order to prevent the 3B4 comparison...who knows, maybe its worth a shot.

First, I am behind this resolution 100% and hope the other Council's take up similar resolutions.

With that being said, it is EXTREMELY difficult for someone (labor group/union) to prove "intent" or "intentional acts" for the sole purpose of "influencing negotiations".

Again, I hope this gains momentum, but won't be 'counting checks before they're cashed' on this resolution.

This will be interesting to see where this goes.

I can not but think management out smarted us yet again. Not really out smarted us, but just another reminder that they hold all the cards. Lets go back to October of last year. When the company unilaterally altered the PS plan to have an October pay out. At that point they created a new "past practice" by showing they can make changes to the PS plan and compensation of its employees. This bolsters their case that the changes to the 2016 PS is normal business. The argument will be the pay rates had to change at the same time as the pay going into the 2016 plan, hence early.

Not that I agree with them, this is just what the neutral will have to choose from.

744 pilot feeling left out. The Whale will be here for a little while longer!

As a former Council 1 member, I think it's great to see the "origins of ALPA" take the horns on this issue when ALPA as a whole is far off the original path envisioned by David Behncke. Hopefully our other councils will support the movement.

Translation: Council 1 helped blow $1.1 billion for Delta pilots and now we are going to try to blame everyone else for our bad decisions. You can chalk this up with the "me too" grievance and the "trip rig" grievance as another $1 million flushed down the toilet. Can't Lewis and Hall just man up and accept their decision? Nope. Got to find a scapegoat. What a bunch of pathetic losers.
