Reg change regarding 61.51

Default Reg change regarding 61.51

I thought of this after reading Bellancas thread......

I was giving a guy a flight review whos flight review was expired, was private asel.

While filling in his logbook i wasnt sure whether I should fill in PIC time for him or not.

Without a flight review you cant act as PIC.

But i was curious if you could log it.

61.51(e)1(i) has changed (sole manipiulator area)

It used to read "which the pilot is rated or has privelages"

it now reads "which the pilot is rated or has sport pilot privelages for that category and class of aircraft, ......"

before the change the "or has privelages" part i would assume could mean flight review and i wouldnt log it without a current flight review.


but with the change they took that part out.

it now, in my opinion says that for a private pilot to log sole manipulator PIC time, you need to be rated.

i logged PIC time for this guy.

Not sure what is exactly the correct answer.

I think that was always the answer. Rated = holds a certificate in category/class/type. Has nothing to do with concurrency.

I'm not sure what "privileges" means, maybe a catch-all for special cases such as military pilots who have completed a military training program for a military aircraft which is also civilian certified.

"privileges" was added when the sport pilot regs were added. It always referred to sport pilot privileges. The October 2009 amendment was truly a clarification - there were a couple of arguments being made that would expand it to other types of privileges (law of unintended consequences).

Your "student" could always log it as PIC without a current flight review because he's rated (that part of the reg has been the same for more than 30 years). Maybe this will help: note the word "or" between "rated" and "has privileges."
