Regarding the DAL Application portion of Airline Apps

One of the questions is:
"Have you ever been convicted of any felony, misdemeanor, infraction, offense of other violation on any law? NOTE: "Nolo", "Nolo contendere" or "No Contest" are pleas just as are "Guilty" or "Not Guilty". Simply entering one of these pleas does not necessarily mean a person avoids being convicted. Whether you were convicted depends on the final disposition of the court. Do not list arrests that have not resulted in a conviction. A previous conviction will not necessarily disqualify you from consideration for employment. However, see the last page of this application regarding terms and conditions of employment for information about restrictions imposed by federal regulations on certain Delta jobs. If the answer is Yes, list the details for all convictions in the space provided below. Violations for parking should not be listed, otherwise list all other convictions and provide details for each."

I have only received speeding tickets as well as a ticket for failure to come to a complete stop at a stop sign. What are your thoughts regarding those tickets and that question? The only violation that would not need to be reported, per their statement, is a parking ticket but if I was pulled over for speeding and mailed in the payment does that count as a "conviction"? I do not want to list things if there is no need to but I do not want to be called out, during and interview or class, for not being truthful.

Read closely what you signed when you mailed in that fine. You agreed to plead guilty to the charge against you and pay the fine as restitution. You must disclose those.

Dakota,
The Delta app has a seperate section for your driving record. It says "Please enter any information concerning driving violations. Include all infractions involving payment of fines, court appearances, and/or assessed penalties. If none, please continue to the next page". I think the section you are looking at covers things other than driving since they have a dedicated section for driving. When you enter the ticket information it also asks you if you were convicted of it or not, and what the disposition was. I know this because I had to list two tickets! Also, I'm guessing the reason they ask for all your drivers license info is so they can do a records check. It would sure suck to not own up to them on your application and then have it come up in an interview. That would probably lead to "What else is he not telling us" which would suck even more.

Thanks. I did list all of the items on the "Infractions" page of Airline Apps. I did list those items on the "My Addendums" page because they state:
"Have you ever been convicted of any felony, misdemeanor, infraction, offense of other violation on any law?"
AND
"Violations for parking should not be listed, otherwise list all other convictions and provide details for each."

A speeding ticket does not count as a parking violation and it is an "other violation on any law". I agree that it is odd for them to want speeding stuff 2X but I also think that, per their wording, a speeding ticket is not necessarily exempt from the convictions area of the addendum.

Continental has a similar question:

** ANSWER THIS QUESTION HONESTLY, WHETHER OR NOT YOU BELIEVE YOU PRESENTLY SHOW A CONVICTION ON YOUR CRIMINAL RECORD AND WHETHER OR NOT YOUR LAWYER TOLD YOU SOMETHING WOULD NOT COUNT.

16. Have you:
A) Ever been convicted or is there now pending against you a misdemeanor or felony (civil or military charge);
B) Received deferred adjudication (even if your case was later dismissed);
C) Been part of any sort of diversion program in lieu of a conviction (even if your case was later dismissed);
OR
D) Paid a fine
/ performed community service/ served any jail time?

Yes No
If yes, please explain:

NOTE: A conviction does not automatically mean that you will not be offered a job. The crime of which you were convicted, circumstances surrounding the conviction, and how long ago the conviction occurred are important. Please provide complete information so Continental Airlines can make an informed decision.

So, for instance, I have paid a fine for speeding tickets already disclosed previously in the application, but this question is heavily framed as criminal activity. Or is it a cross-check? Will the robot toss your application out if you go the paranoid route and click "yes" to re-fess up for speeding?

Hmmmmm debate debate. I hear you, man.

On the application it does't state how many years of history they want. Are you guys going back 10-15 years??

A good check is to go to your local DMV and get a release of your driving history. This will enable you to put things you might have forgotten along with exact dates.

You need to list the speeding tickets and failure to yield to a traffic control device (stop sign).

This can vary between states, but do company policies allow for that variation? In many states traffic tickets are handled as civil settlements/forfeitures, so if they're not handled by the criminal courts, they wouldn't be considered "convictions." I guess I would seek clarification on whether the company policy recognizes them as such, or if they use a broader definition. In any case, it's good that you're trying to avoid the risk of misrepresenting yourself on an application, as that's usually grounds for immediate termination!
