Its just not that simple.

In any case, like I said, even if this was the worst case as implied, and most cases aren't even close, then all we have is one example in a billion man hours of dealing with this kind of thing every day. If its just an unfortunate accident in a common operating environment where sometimes people have to stay seated, and sometimes things like this are inevitably going to happen, then I really hope no one gets paid from this. I'm sure because it made the news its an automatic 6 figure pay day though.

Either way, the JETBLUE MAKES KIDS PEE/POOP THEMSELVES BECAUSE THEY ARE MEAN EVIL CHILD HATERS rhetoric victim card playing crap is just. played. out.
When the seatbelt sign is on, as long as the FA conveys that the sign is on and that a passenger should be seated, the airline is legally covered if a passenger then falls or is injured in turbulence. I've always thought the FA job should be to notify the pax, not force them into a seat when they have to go to the bathroom. This sounds yet again like a FA power trip. I've had quite a few times during taxi out/in that hte FA calls and says someone just got up and rushed into the bathroom. We say ok and stop. It's an inconvenience but it is what it is.

Some flight attendants have confused there duties in this post 911 world. They think passengers are criminals that they have been charged with supervising for the duration of the flight. I hope the inflight manager gives this flight attendant a good talking too.

A continental FA told me they are trained "You are informers, not enforcers."
I hope all airlines train their FA's this way someday.

What legal system do you exist in that believes that simply because an "announcement" was made, the airline is and will be free of any charges of wrong doing if an injury is caused??????

Make all of the announcements your heart desires but you're not clear of any claims of wrong doing.

This lady broke her neck when the seatbelt sign was on and an announcement was made. The airline is covered under what Barrister ShyGuy Esq. tells us..nope, she is claiming the announcement wasnt loud enough to hear. The case has been up to and including involvement with the Supreme Court of Texas.

Straight cash, homie. That is what she wants.

I guarantee that in trial, all crew members will be called to testify.

Im not saying this relates directly to the JetBlue case, but I believe a crew can always be held responsible for any injury caused on an aircraft, regardless of announcements or signs.

Yep. It is quite acceptable for the F/A's to move around as they please on the taxi under these "strict" rules, but god forbid you let a kid use the lav. It is much better for everyone if they simply soil themselves. Yet another F/A on a power trip, and backed up by a weak captain no less. At least the deadhead pilot had some common sense.

What a bunch of clowns.

Maybe they were on tarmac! I think the DCA ramp used to be paved with that stuff. On a hot day, our Mad Dog threatened to sink like a Dire Wolf in the La Brea Tar Pit. We would force the nose wheel up a wooden ramp, or else the pax would have to pole vault to reach the jetway. Didn't need yellow lines to taxi, because the airplane would just follow the wheel ruts, like a wagon on the Oregon Trail.

FAs won't sure if they fall down either..... Like gloopy said, it is not a cut and dried situation.
