if they have already made closing arguments it sounds like this case is on the fast track. Will a ruling be made next week?

I don't think MAG can use the "we'll have to file bankruptcy" or use the "plane leases and no customer" cards anymore, since they're already in bankruptcy protection and have permission to dump all the a/c on the leassors with 10 days notice. It'll be interesting to see what the ruling will be.

If the court system has any memory, they'll throw out Unca Don's testimony.

Last time he was in the witness seat, he testified that Delta could grow Comair if only the judge ruled to throw out Comair's pilot contract.

The judge did just that, and then Delta awarded planes to Pinnacle and Freedom. Unca Don's a lyin' ***.

This is not a ruling about an injunction, it is a trial. If Delta wins they can cancel the contract immediately, assuming another injunction isn't applied pending an appeal.

However, keep in mind that the fact that the cancellation would have caused a BK was not the sole reason an injunction will be granted. You also have to show that you will probably win in trial as well.

As I recall all Dash-8 flying with United is to be phased out by April 30th (this Friday). I'm sure some, if not most of the aircraft have already exited service as of today. What is the fate of these aircraft? Are they all to be returned?

They'll probably keep Barney (unmarked white and purple Dash) that we used as a spare for both US Airways and United. The united Dash-8s have an FMS though, which is nice. If I was still working I'd rather have them than the /A aircraft in phoenix.

The timing of the final order is entirely up to Judge Cooper. This was a bench trial, meaning no jury. In a bench trial the judge plays the role of the jury as "finder of fact" and is free to make the "conclusion of law" (Ever heard of Judge, Jury, and Executioner?). The details are not available, but if both parties agreed to a "consent judgement" then the final order will be binding. The judge can always "reserve judgement" if he would like to consider the case further, but bench trial final orders usually don't take very long.
