Default AFRC LOD process

Folks,

Anyone else previously have, or are having trouble with the AFRC medical Line of Duty process? I had 2 LODs approved by my CC, OG, and Group JAG, then changed to Not In the Line of Duty by the AFRC LOD board (it took the LOD board 12 months to return the NILOD) I filed an appeal to both LODs and both appeals denied (both appeals took 12 months).

Via my medical records and every Doc I have seen, there is no question my spine injuries ARE in the Line of Duty... I’ve been a T-38 Reservist for 12 years, previous F-16 pilot, after a 38 sortie I had acute neck pain, Doc ordered MRI and I have 2 herniated discs. Other LOD lumbar, long history of lumbar pain, lumbar spasm on duty, MRI, 3 bulging discs.

I had a Colonel Flight Doc suggest a congressional inquiry. This is my next step.

In the meantime, during this adysmally long LOD and LOD appeal process, I filed VA claims. The VA process was smooth, and went very well. The VA found service connection for my spine injuries because they did occur in the Line of Duty.

So, anyone have advice? Thank you!

I’ve been out of it for a long time, but is the HQ AFRC argument based on the LOD occurring on AD, not in Reserves? I know it sounds silly, but AFRC argued that way for years over retirements where the points were earned on AD and AFRC didn’t want reservists retiring out of reserves.
