Default Settle a debate please....1st class medical

Dates changed to protect the innocent I have a beer riding on this......

Pilot's date of birth July 16,1970
Pilot is exercising privileges that require a 1st class medical certificate

Pilot's current 1st class medical dated July 6, 2010. He was 39 years old at the time of the examination (10 days short of his 40th birthday).

I SAY: This first class medical is good until July 31, 2011, and he can exercise his privileges that require a 1st class medical until July 31, 2011, because he had not yet reached his 40th birthday at the time of examination.

Am I missing something????

This pilot's boss thinks that he needs to get a 1st class medical exam by Jan 31, 2011 because he has since turned 40.

A first class medical certificate is valid for the remainder of the month of issue; plus
  • 6 calendar months for operations requiring a first class medical certificate if the airman is age 40 or over on or before the date of the examination, or
  • 12-calendar months for operations requiring a first-class medical certificate if the airman has not reached age 40 on or before the date of examination

Debate is settled...since you were not yet 40 at the time of the exam, the 12 calender month time limit is correct.

If you really want assurance, contact your FSDO and ask THEIR opinion...they would be the ones to make any determination...even if they were wrong.

Just for laughs, call 4 different FSDO's, and see how many different answers you get.

And, just like IRS statements that can be wrong, you will still be held liable no matter what the official agency position(s) is(are).

I've had a Fed tell me my medical was out of date on an enroute because it was later in the month than the date the medical was issued - he thought it was 180 days. And I've had a Fed tell me the second class medical for a F/E is different than the second class medical for a pilot.
