Default Ex Independence Air pilots

Does anyone who used to fly for IA. have a contract that is in pdf. form? With the sale of the certificate to NWA, I was wondering if there was any scope tied in to the contract. Let me know if you have any info. Thanks in advance.

Out of curiousity, why are you asking? NWA bought the certificate of a defunct airline, not the airline and all of it's assets. The busses are gone and so are the CRJ's.

A question was brought up at one of the local meetings in DTW about what happens to the pilots at IA. I am not a legal beagle, but I thought there might be some language somewhere where the pilots might be tied to the certificate. Just curious!

From what I remember, there was some language that addressed an acquisition or sucessorship and the usual senority integration/protection and "career expectation" stuff that goes with it.. There was also wording that said if a certain percentage of aircraft were handed over/bought/whatever to another operator all pilots on that fleet type would go with it as well.

All of this is assuming that the other carrier was also an ALPA carrier. How well it would hold up if a non ALPA carrier was the other party, well, look at TWA/American to get a worst case example.

Since the airline is gone, the airplanes have been handed over to the lessors, ect, I would doubt that we (the pilots) from IA are entitled to anything. Sadly. Looking at the TA, I don't know if I would want to be.

You are right about the TA. It is a said situation at NWA. I can honestly say I will never return. Thanks for the info. You would think our MEC would be on top of that stuff.....,but they had no clue. Take care!

There is some legal grey area on this issue since the company is not being liquidated in CH7 proceedings. Lemme dig up my contract... I'll post the scope/merger clauses here in a bit.

I will give my identity away, but I was at Kalitta for 2 years and now I'm at UPS. I will always be a fr8ght dog. (Just as long as I don't have to return to Willow Run!) LOL!

I don't think it will matter at all. Every pilot that was on the seniority list was terminated. Furlough letters came out then termination letters. So there a not really any pilots tied to this ticket. Just my 2 cents. Just keep Skeen and Moore away from the danged thing.
