Has anyone ever timed out?
When you reach 1,000 hrs, can the company legally make you work any more? For example, "office work," or ferry flights, that sort of stuff. I'm 99.9999% certain that ferry flights count towards the 1,000 hrs/yr, but our mgmt preaches that it's legal for 8 hrs/day, 16 hr duty, etc. as long as it's at the tail end of the day. I'm not so much worried about them trying to make me do part 91 stuff because I know it's illegal... but knowing my company, I'm anticipating that they'll try to make me do SOMETHING... I am just wondering if I have any legal rights regarding NOT doing office work (i.e., anything not pilot-related.)
Also, if I end up not working at all in December, is the company legally obligated to still pay me the 75 hrs guarantee pay? I would assume that that's why it's called "monthly guarantee," but I'm wondering if there is any legal way the company can get around NOT paying me, since I'm not working at all. ugh, the stuff that you have to worry about when you work for a shady airline with no union. :( |
It would depend on what your union contract says... but per FAR's after you hit 1000 in the calendar year you are done with 121 flying but could still do 91 flying. Pay again would depend on contract, but I don't know of any place that you wouldn't be still getting your monthly minimum...

SkyWest quits paying you if you time out. They will also make you sit reserve for ferry and mx flights.

Everyone I know in 121's ops that timed out for the year made guarantee their last month. Thats a lot of work!
But then again they were all union... unlike Skywest. |

After I hit 1400 flying 121 I got paid unemployment by the government... god bless the USA.

I timed out one year at XJT. I worked all year to make it happen. Ended up with 994 hours in the last week of NOV. I timed out and they had to drop my last trip in NOV and then i bid a line in DEC that was worth 103 hours pay. They had to pay me for everything they dropped. I then bid the first 2 weeks of JAN off also. Ended up getting paid for 2 months without ever having to go to work. It was fantastic.

I was on pace to do the same at TSA, but I stopped picking up time when we started furloughing...I'll still only have 50 hrs left in DEC
