You are correct - and I agree with both your points. It was a win for Privacy and if they did care about something like that then I wouldn't want to work there either - but a question remains about why she would INVITE her employer onto her Facebook page in the first place. I have to wonder if that is even the case. It sounds like they *heard*(?) that she might have some incriminating evidence on her Facebook page and they went after it. This one was a win for privacy.....will we be so sure that the next one will be too. If you are going to post your life on the net - then just be careful with what you put there for the masses to see.
Btw - in this case - if she is bilking the employer for disability when she is fine then shame on her too.

A subpoena can be a part of the discovery process. It is normally used to compel witnesses or other third parties to appear in court or turn over evidence.

Depends on the privacy setting. If you don't have anything selected anyone can view it. For mine personally you can only see my name then I have to personally approve anyone. I love using facebook. I have several friends in the military and other jobs that have taken them far off and it's great to be able to catch up and share pics. It's really helped me stay close to people I haven't seen in a long time.

I was having this same discussion with my GF last night. She also LOVES Facebook - for all the same reasons that you list. Personally - I use E-Mail for the same thing. I didn't know that it depended on the Privacy settings. all the profiles that she has shown me - once you search for a name and then click on the profile say something along the lines of you must request to be a friend of XXXX. I thought that was one of the big differences between Facebook and MySpace - but as you see - I don't know that much about them
