Technically they are not required to be part of the negotiations. They are not even required to be present, just notified. So they are being done a favor. Nothing in the T&PA has been violated. But it's important to point out that the only reason why they are negotiating smartpref outside of JCBA negotiations, is because the ASA MEC does not want to abide by the Process Agreement for Interim and Single PBS.
As for being the larger pilot group, my suspicion is that that is brought up to point out that nothing will be ratified unless the TA is not concessionary to the larger voting demographic. It's just simple math and the reality of the situation. And this smartpref outside if JCBA is part of that as well.
