The DOJ would have a good case if it was two years ago. They fail to recognize the current climate. If JetBlue and their lawyers fail to capitalize on that, then they deserve to lose.

the board voted unanimously for frontier. Multiple times. Even if he had been very anti-frontier it still would been favored 8-1. (Pretty sure 9 board members)

Based on what I read in B6 pretrail brief, B6 lawyers will capitalize on it.
