That's discussed in the ruling. The barriers of entry weren't the main problem, the main issue was that no other competitor is big enough that they could grow into those overlapping routes. He used some pretty absurd %ages in there and strict timelines when this would have to happen for it not to be anti-competitive, Allegiant would have to grow 500+% in 2 years, Frontier 300% and so on.

yes, my wife specializes in appeals. The court will consider the circumstances to expedite and will even consider the application of the law because things have changed. If the deal doesn’t go through and the company fails, business model means nothing.

Good info, thanks. Hopefully it doesn’t come to that. What does your wife think of the chances of winning an appeal at the next level (I forget what it’s called, the one before the Supreme Court) or will this have to go all the way to the Supreme Court? And how long those processes would take? The July 24, 2024 outside date isn’t very far away.

the supremes would have to decide to take it so she thinks it will live or die in court of appeals .
