Presumably it wouldn’t have even made it onto his docket with a different administration.

Hopefully the republicans can nominate one of the two viable sane people running and we kick the two old imbeciles back to Delaware and Palm Beach.

He’s saying that any other prior administration this lawsuit wouldn’t have happened, or it would have been settled with divestitures. The fact that the DOJ pushed this hard is unique to the Biden DOJ.

I think Chapter 7 liquidation is a bold forecast. And I don’t agree with her assumption that “no other airlines will step up” to offer a merger. I guarantee Indigo/Frontier is still interested and they like their chances. Virtually all the arguments made by the judge are not applicable in a Frontier-Spirit Merger. Merger agreement 2.0 coming in 2024, approval in 2025. And really fair chance the White House changes hands at the end of 2024, which would ensure DOJ approval.

There might not be much left to buy at that point. Spirit just sold off planes, deferred deliveries, and attrition will probably uptick again. Unless Ted has some sort of magic plan to turn it all around, it doesn't look very good.

The Judge didn't sue to prevent the merger... the DOJ did.

Who does the DOJ answer to? The White House.

So if Biden tells the DOJ to sue someone, they do it.
