I think it is a reach to blame this administration. If you want to blame someone for this merger not going through, I would blame JetBlue management. I truly believe that they started looking for the quickest and fastest escape offramp to get out of the merger once they got cold feet. Their arguments in court for the merger didn't do them any favors and then filing for the appeal and then shortly pulling the plug afterward was in my opinion a half-assed effort on their part to fight for the merger.
Bottomline, Spirit management is to blame for the position that Spirit is in today, having to rely on a merger to bail them out. It is unfortunate too.

spirit management is to blame yes. Biden administration is 100% to blame. If they had not contested the merger it would be half way completed and some bank would have infused plenty of cash to overcome any headwinds until we could start making money w an 8000 pilot airline and diversified profitable product line.

Especially in conservative circles, claims are made that judges are “activists” seeking results and need to instead follow the “text” of the law. Well… that’s exactly what both the DOJ and the judge did in this case. They followed the text of the law.
I agree that the best outcome would’ve been for the merger to be approved and I feel awful for you guys, but let’s be real about where the blame lies.

Please correct me if I'm wrong here. Didn't Spirit shareholders vote in favor of the JB merger over the F9 merger? Didn't NK management warn shareholders that they were not confident that a JB merger would be approved? So if NK mgmt warned against a JB merger and the shareholders voted for the JB merger anyway, is there not an argument here that the NK shareholders have a large share of the responsibility for the current situation?

Exactly this. Biden issued a executive order that mandated his DOJ to go after M&A. Spirit is a total POS airline don't get me wrong but the facts are the facts. Joe Biden is the reason we are where we are.
